Democracy Live Inc., believes privacy is very important and we will always strive to be transparent about our use of the information that you provide us. This policy (the “Privacy Policy”) outlines the types of personally identifiable information and other data that we collect from you through the OmniBallot voter web sites (the “Voter Sites”) or any information provided by our customers (the “Customer”) as a part of account setup, configuration or support services (the “Services), and how we protect data and voter privacy. Your use of the Portal and/or submission of information to us constitutes your consent to this Privacy Policy.
Democracy Live Inc., (“Democracy Live,” “we” or “us”) operates Voter Sites at sites.omniballot.us as a Software As A Service (SAAS) for Customers. Customers can also white label the Voter Sites with a custom domain name. This Page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive across all Voter Sites.
Types of Data We Collect
There are two types of Data we may collect from your use of the Voter Sites:
- “Personal Information” which is the type of information that can specifically be linked to you personally, such as your full name, physical address, email address, telephone number; and
- Non-Personal “Usage Data” which is anonymous data about your use of the Voter Sites that is linked to your computer and/or device through which you use the Voter Sites.
Protection of Certain Personal Information
Your privacy is critically important to us. At Democracy Live we have a few fundamental principles:
- We don’t share, sell or make public any information stored in OmniBallot or entered in Voter Sites.
- All information stored in OmniBallot is owned by Customers.
- We never collect, aggregate, or store any information related to ballot marking or activity.
Democracy Live will not make public, rent, or sell any information stored in OmniBallot or entered on Voter Sites to anyone.
Voter Database Extracts
Voter Sites are highly configurable to meet specific needs of Customers. In certain configurations, Customers may utilize a Voter Lookup application in order to provide an accurate ballot to voters. The use of this tool requires a Voter Database to be populated from an administrative application. Only information relevant to the Voter Site configuration for a Customer is imported into the Voter Database. Customers may provide Democracy Live with a partial voter database as part of Support Services.
Voter Databases are used only for voter lookup and verification purposes inside the Voter Sites. Democracy Live does not access Voter Databases outside of Support Services and does not own, sell, or distribute Voter Databases in any way.
Gathering of Usage Data
Like most website operators, Democracy Live collects information that your browser sends whenever you visit our Voter Sites (“Usage Data”). This Usage Data may include your computer’s IP address, your mobile phone unique device ID or other persistent identifiers, geolocation information, your devices software platform and firmware, the type of browser you use, the date and time of your use of our Voter Sites, the actions you take within the Voter Sites and the URLs you used before or after using the Voter Sites.
Usage Data is solely used by customers for reporting requirements or to gain insight of how visitors use the Voter Sites. Democracy Live may access this information to fulfill Customer Service requests, but does not otherwise access, use, distribute, or sell Usage Data in any way.
Gathering of Personal Information
In certain configurations, Personal Information is requested in order to identify the voter and provide voter specific balloting content. The information requested depends on Customer requirements and Voter Site configuration. Information entered by the Voter is validated against the Voter Database. Personal Information entered as part of this process is not stored or tracked in any way.
Some Voter Site configurations may request additional information through Voter Forms. Information requested in Voter Forms will vary by Customer and will be specific to Customer needs.
Information collected by Voter Forms can be used to customize the Voter experience and/or provided to the Customer. Any information collected through Voter Forms is owned by the Customer and is not used by Democracy Live in any way.
Use of Personal Information and Usage Data That We Collect
Democracy Live may disclose Personal Information to those of its employees and contractors that (i) need to know that information to process it on Democracy Live’s behalf or to provide Services available at Democracy Live’s Voter Sites, and (ii) that have agreed not to disclose it to others.
Democracy Live may discloses Personal Information (i) to the extent we are required to do so by law; (ii) in response to a subpoena, court order or other governmental request; (iii) about an ongoing legal proceeding; or (iv) when Democracy Live believes in good faith that disclosure is reasonably necessary to protect the property or rights of Democracy Live, third parties or the public at large.
Usage Data may be used for administrative, analytical, research, optimization, security, and other purposes. Specifically, we may use your Usage Data to help us learn more about your use of the Voter Sites, compile statistics, respond to Customer inquiries and provide security.
Data Removal
Customer data stored within Democracy Live systems is owned and managed by its Customers. Data is permanently deleted within one week when a contract is cancelled or after 90 days after the most recent election (whichever is later) due to OmniBallot data security configurations. Customers can also submit a data removal request to delete all or part of the data stored in Democracy Live systems. When a data removal request is received, Democracy Live will perform data deletion within a timeline which satisfies Customer requirements.
Cookies
A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Democracy Live uses cookies to help Democracy Live identify and track visitors, their usage of Democracy Live Voter Sites, and their Voter Sites access preferences. Democracy Live visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Democracy Live’s Voter Sites.
Breach or Incident Notifications
In the occurrence of a breach or incident involving personally identifiable information (PII), Democracy Live’s response will follow steps as documented by each State’s and or Territory’s Data Breach notification rule requirements. Legal Disclaimer
Our Voter Sites operate “AS IS” and we do not represent or warrant that our Voter Sites will be available always, or that your use of the Voter Sites will be uninterrupted or error-free. We are not responsible for your ability to access the Voter Sites for matters beyond our control. This Privacy Policy is governed by Washington State law, excluding its provisions of choice of law.

Democracy Live reserves the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Voter Sites after we post any modifications to the Privacy Policy on this page will constitute your acknowledgement of the modifications and your consent to abide and be bound by the modified Privacy Policy.
If we make any material changes to this Privacy Policy, we will place a prominent notice on this website.
